20minuten, a free Swiss newspaper, published an article today covering Zattoo, in which the journalist kind of made me state that consumption of TV through Zattoo is not subject to the Swiss TV and Radio tax (a.k.a. Billag fee).
Reality is a bit more complex. We talked to Bakom back in November 06. Their press contact told us that “Zattoo is the unique single only service in Switzerland that is Billag-free. Here’s why: The ruling by Bakom regarding Billag fees is actually in favor of Billag and makes it very clear that if a subscription fee is charged by the provider, even for Internet TV, then Billag must be paid as well. Zattoo, however, being subscription (fee) free, is the sole exception.”
What do we think? There’s a good chance (98%) that you’re paying the fee already, so no reason to worry or to do anything. If you never bothered to pay Billag for your good old television set, the Zattoo experience of television anytime anywhere should be a good reason to start doing so…

Wow, is the channel line-up for real? all the scandinavian channels? SVT, NRK, DR? That would be so cool, I can hardly believe it. That would make Zattoo really unique, no cable operator or satellite can make these channels accessible, they show lots of original broadcasts with subtitles. Please launch them as quickly as possible! Thanks a lot Zattoo, this is o-so great!!!!

our conclusion was: they should include the billag fee directly in the taxes… which would make billag completely useless (and jobless).

I had the same discussion with some friends and on first sight you’re perfectly right.
But if you think about it longer: Where will it end? If the billag fee is included in the taxes, why don’t we add Autobahnvignette, Velonummer and basic healthcare-insurance too? 😉 We don’t, because this all works by the costs-by-cause principle. You might not belive it, but so does the billag fee. Yes, there are people out there that don’t have to pay billag or who just don’t watch TV. 😉
If you feel disturbed by the billag bill, why don’t your try LSV? 😉
Don’t get me wrong: I’m not a fan of billag, because I really don’t get it why I’ve to pay that much. I think SF could do it’s service public with half as much stations and half of the money.

grundsätzlich bin ich keine anhängerin davon, dass man fernsehprogramme, filme und anderes platz-brauchendes übers internet vermittelt; dafür gibts die bereits vorhandene infrastruktur; so wird das internet übermässig «verstopft» bzw. verlangsamt. und so ist dann der zwang da, weitere kapazität auszubauen — für teures geld.
habe trotzdem aus interesse zattoo runtergeladen und ausprobiert. unser prinzipiell guter internet-anschluss ist zurzeit offenbar nicht so toll — und zattoo dermassen unbrauchbar… (ab und zu ein bild, ab und zu ein tonbrocken).
wie gesagt: dafür gibts die bereits vorhandene infrastruktur!

Finde Zattoo ne super Sache und das Channel-Lineup ist einfach der Hammer. Den einzigen Wunsch den ich noch habe, wäre ein grösserer Buffer, damit alles noch reibungsloser funktioniert.

well, i think billag is a joke. why pay for stupid stuff i don’t want to watch? i can’t have satelite tv, so i am not billag free. to other channels: they should be happy that we still watch this commercial filled and completely brainless infotainment just because we are lazy enough to not search info and enternainment in other medias/occupations.
on the bakom site it says: “Voraussetzungen für den privaten Empfang von Fernsehprogrammen via Internet:”…”Empfang über entsprechende Software (z.B. Mediaplayer, Realplayer)”…”Wenn diese Voraussetzungen erfüllt werden und keine anderen Fernsehempfangsgeräte im Haushalt vorhanden sind, besteht eine Meldepflicht für den Fernsehempfang via Internet.”
i don’t understand why zattoo is billag free? i think they just can’t handle the complex situation that is coming up with this new methods of watchîn tv. how can they control that every pc user does not have zattoo installed? maybe over the IPs, zattoo could give them. but what a big effort! and i guess zattoo does not have to give out IPs to anyone. there would be a case in front of court, and i guess also billag/bakom wouldn’t be very intrested in ruining a company that is begining to explore the future. it wouldn’t be loved by us too 😉 .
but it’s an interesting development… and i am curious how this is gonna turn out. because the “new” RTVG does not really cover this stuff so big playground for every internet related streaming techniques.
they should better invest some of these taxes into 100MBit lines for private users ;). sorry for long comment.
zattoo… keep it up. and well SRG, uhm… make better program or give me video on demand for this billag money…. then i could at least cut the crap.

Im a Zattoo user since one of the earlyer betas and the software just keeps getting better. I didnt even know that Zattoo is a “swiss” Project till i read an article in the “Aargauer Zeitung”.

Ist wohl in der Tat umstritten, denn bei Billag steht, dass alle TV-Gebühren bezahlen müssen, die einen HIGHSPEED-Anschluss haben… egal ob je übers Netz (in welcher Art auch immer) TV geschaut wird! Ob ich nun Sunrise-Desktop-TV schaue oder Zattoo spielt anscheinend keine Rolle. Es steht klar und deutlich bei Billag, dass quasi der Anschluss ans Internet massgebend ist. Habe ich also kein TV-Gerät mehr als solches zu Hause aber besitze einen Highspeed-Anschluss bin ich verpflichtet Billag zu bezahlen. Kann mir also somit kaum vorstellen, dass man somit wenn man Zattoo schaut keine Gebühren bezahlen muss!?

Das Gesetz sieht folgendes vor:
Die Pflicht zur Bezahlung von Empfangsgebühren ist ein zentraler Bestandteil des schweizerischen Rundfunksystems. An diesem System, welches in den meisten europäischen Ländern üblich ist, ist festzuhalten (Art. 76). Bevor Haushalte und Gewerbetriebe ein zum Programmempfang geeignetes Gerät zum Betrieb bereithalten oder in Betrieb nehmen, haben sie dies wie nach geltendem Recht der Gebührenerhebungsstelle zu melden. Anders als in gewissen ausländischen Staaten (z.B. Deutschland) ist die Gebühr in der Schweiz nach wie vor nicht pro Empfangsgerät geschuldet – ein Kriterium, welches erhebliche praktische Probleme verursacht – sondern pro Haushalt oder Gewerbebetrieb. Neu ist dagegen, dass gewisse Kategorien von Gewerbebetrieben höher belastet werden können (Art. 78 Abs. 2). Damit werden Differenzierungen möglich, welche
dem Rechtsgleichheitsgebot grössere Beachtung schenken als die geltende Pauschallösung. Es ist sinnvoll, einen kleingewerblichen Handwerksbetrieb geringer zu belasten als grosse Dienstleistungsunternehmen wie Hotels, Warenhäuser oder Transportunternehmen, die den Rundfunkempfang zur Steigerung der Qualität ihrer Dienstleistung einsetzen und ihn auf diese Weise kommerzialisieren. In diesem Zusammenhang sind auf Verordnungsebene weitere, zahlenmässige Differenzierungen
denkbar, welche beispielsweise an die Anzahl Zimmer in einem Hotel oder die Anzahl mit einem Radio ausgerüsteter Autos in einem Taxibetrieb anknüpfen. Zur Durchsetzung der Gebührenpflicht wird es auch künftig notwendig sein, Massnahmen gegen Schwarzsehende oder -hörende zu ergreifen. Diese unterliegen auch künftig einer Strafdrohung. Artikel 107 Absatz 1 sieht – wie bislang Artikel 70 RTVG 1991 – eine Busse von bis zu 5000 Franken vor.
Das ist der Text der Botschaft zu den Empfangsgebühren zum neuen Radio- und Fernsehgesetz.
Es ist auch heute schon klar:
Art. 55 RTVG Empfangsgebühren
Wer Radio- und Fernsehprogramme empfangen will, muss dies der zuständigen Behörde vorgängig melden. Er hat eine Empfangsgebühr zu bezahlen.
Künftig lautet der Gesetzesartikel:
Art. 68 RTVG neu Gebühren- und Meldepflicht
1 Wer ein zum Empfang von Radio- und Fernsehprogrammen geeignetes Gerät (Empfangsgerät) zum Betrieb bereithält oder betreibt, muss eine Empfangsgebühr bezahlen. Der Bundesrat regelt, welche Gerätekategorien als zum Empfang geeignet gelten, und bestimmt insbesondere, unter welchen Voraussetzungen Geräte, die auch
für andere Anwendungen geeignet sind (multifunktionale Geräte), der Gebühren- und Meldepflicht unterstehen.
2 Die Empfangsgebühr ist pro Haushalt oder Geschäftsstelle unabhängig von der Zahl der Empfangsgeräte nur einmal geschuldet.
3 Wer ein Empfangsgerät zum Betrieb bereithält oder betreibt, muss dies der Gebührenerhebungsstelle vorgängig melden. Ebenso zu melden sind Änderungen der meldepflichtigen Sachverhalte.
4 Die Gebührenpflicht beginnt am ersten Tag des Monats, der dem Beginn des Bereithaltens oder des Betriebs des Empfangsgeräts folgt.
5 Sie endet mit Ablauf des Monats, in dem das Bereithalten und der Betrieb aller Empfangsgeräte enden, jedoch nicht vor Ablauf des Monats, in dem dies der Gebührenerhebungsstelle gemeldet worden ist.
6 Der Bundesrat regelt die Einzelheiten. Er kann bestimmte Kategorien von Personen von der Gebühren- und Meldepflicht befreien.
Fazit: Auch mit Zattoo sind die Empfangsgebühren zu bezahlen. Nicht aber jene für die Verbreitung z.B. Cablecom

I had a man from Billag come to my door two evenings ago at 19h30 to see if I had broadband internet and since I do, I MUST pay the billag redevance for radio, so they do check and will probably make us pay soon counting the adsl as a tv.

Die Billag ist ein abgekarteter Haufen. Grundätzlich muss ja eh jeder bezahlen. Macht mal ne hochrechnung. Ich kenne einge, die keine Fernseher haben, aber alle haben Highspeedinternet. Wieviele Personen kennst Du, die beides nicht haben ? Nehmen wir mal an 1% der Haushalte. Also, dann könnte man die Billag abschaffen und einen Umkehrschluss machen, d.h. alle bezahlen und man muss sich aktiv abmelden und es beweisen, wenn nicht. D.h. wenn Du nicht bezahlen wirst, dann kommt jemand vorbei und kontrolliert. Aber das SF und die Billag stecken unter einer Decke und wollen abzocken. Kontrolliert mal die Geschäftsleitung und die Verwaltungsräte der Billag und dann kommts aus. Das Gesetz verlangt ein Gerät (Computer), einen Breitbandanschluss und ein Abonemment. Gemäss Wörterbuch ist ein Abo ein ent-oder unentgeltliches anmelden bei einem Anbieter (d.h. Zattoo mit der Mailadresse, das man machen muss) und regelmässiger Lieferung (so, und da muss die Billag uns zuerst beweisen, dass wir regelmässig Zattoo konsumieren). Jeder von uns hat ja soviel Schrott auf dem Compi und einige Programme haben wir ja zum Spass runtergeladen und evtl. einmal ausprobiert z.B. Online Casino, Online Poker, Fotoprinting, etc.) So liebe Billag, beweise mal die regelmässige Lieferung von Zattoo an die registrierten Usern, oh ja und mit den Emailadressen kannst Du es eh vergessen, denn wer ist schon george.bush@gmx.ch ? Kann jeder sein. Okay, dann kontrollier mal die IP Adresse der User, dann brauchst Du die Liste von Zattoo, die Liste der Provider und musst hoffen, dass man keine dynamische IP Adresse hat, oder täusche ich mich ? Bitte um Feedback !

oh, uebrigens. Sobald die Billag Listen von Zattoo will, dann empfehle ich der Zattoo Ihren Sitz nach Panam zu verlegen (Billag viel Glück mit der internationalen Rechtshilfe!) oder man wechsle zu joost.com. Und SF kann ihren Service Public sicher auch besser und effizienter mit dem Geld ausstrahlen: Rechnet mal 500 CHF mal Anzahl Haushalte ca. 1 Million ? Das gibt 500 Millionen !! Wofür ?? Für 500 Millionen könnte man Zattoo unterstützen und gute Programme anbieten. Falls Bürger für Bürger TV machen würden, dann hättest Du Service Public. Also da brauchts keine Wichtigertuer wie bei der Billag und dem SF. Und viele von uns würden ja ohnehin freiwillig mitmachen beim SF oder für gutes Geld. Studiert mal die Löhne beim SF. Oder täusche ich mich ?

Aber irgendwann wird das ganze doch ziemlich absurd! Da jeder Student an einer schweizer Hochschule über VPN gratis Internetzugang sowohl an den Hochschulen als auch über andere Hotspots, könnte man die dann auch alle zwingen Billag zu zahlen!?

Here’s an interesting discussion going on. Fact is (as of March 1st 2007), that a subscription free internet TV provider is not subject to Billag TV-fees, but only Billag radio fees.
Remains the question for how long the service of a start up company like zattoo will remain subscription free.
So, you zatto guys, how do you wanna bring $$$ in your pocket without reaching the final goal given from your CEO (making $$$) once you have dealed with the infancy disease of your product?
Does anybody from the zattoo fan club has an idea, how to help these poor guys, so we don’t have to pay this stupid legalized rip-off called Billag in the near future?
